BOATING ACCIDENT
Boating fatalities in the United States have been reduced over the course of the last 15 years, but still, over the last few years deaths resulting from boating accidents number in the 600-700 range. Many more people are injured in boat accidents every year.
These accidents are caused by a number of different things for which damages can be recovered by innocent individuals. Among them are:
-
Careless and/or reckless operation -- Where you may be riding in a boat with someone who, for whatever reason, is not operating the boat safely.
Speeding -- The boat may be operating at speeds that are excessive and in fact in violation of the law.
-
Failure and/or defects in machinery -- The boat is defective as it comes from the manufacturer.
-
Negligent maintenance -- The boat is improperly maintained, which results in mechanical failures that could have been avoided.
-
Hazardous waters -- Where there may not be a proper posting, and/or may be irresponsible behavior on the part of the operator.
Intoxication -- Driving under the influence is no less dangerous in the water than it is on the road.
A boating accident is a boating accident, whether it be in a powerboat, a yacht, a houseboat, a sailboat, a kayak or a pontoon. And depending on the circumstances, a passenger, water skier, operator or even a pedestrian may be able to collect damages as the result of a boating accident.
