BRAKE FAILURE
When you buy a vehicle, you have every reason to expect that the brakes on that vehicle will perform in just the way they are intended - to stop the vehicle when they are supposed to. Sometimes this does not happen, and more often than not it is due to the negligence of others. There are many things that can cause brakes to malfunction. There can be manufacturing defects that will cause the anti-lock brake system to fail. There may be a leak in the brake fluid system. The brake lines may be defective. The brakes may not be sufficiently designed to handle wet weather. On cars which have experienced maintenance, the brakes may not have been repaired properly. Sometimes a problem with the brakes, even on a new vehicle, are not diagnosed correctly by the dealership that is servicing a vehicle on warranty, and that leads to problems that can not be reversed until it is too late.
To give an illustration of what has happened in the past, in 1996 the Chrysler Corporation had to recall 275,000 minivans due to failures and defects in the anti-lock braking systems on those vehicles. Along the way the company had to endure many lawsuits, including a class action. No manufacturer is immune.
This is very serious business. The effects of brake failure are perhaps more potentially lethal than anything that can happen to a vehicle. The car may lose control on a highway, which can easily cause death, or in city driving, which can very easily result in serious injury or death to an innocent pedestrian.
If you or a loved one has been injured in an accident, either as a vehicle operator or a pedestrian, that may have been the product of a defective brake system, the best thing to do is call a professional who can examine the situation and determine the potential financial damages you may be entitled to.
