CONSTRUCTION ACCIDENTS
On a construction job, the worker understands that he will be doing something with a certain degree of strenuous physical activity and an accompanying risk. At the same time, he has a right to expect that the employer or other parties involved with the makeup of that site have taken a sufficient amount of care in ensuring that the site is as safe as can possibly be. When construction accidents occur, it is often because these precautions were not taken. Many construction accidents, in fact, take place because the work area did not assume the level of risk and made conditions inherently unsafe.
About a third of construction accidents occur because the worker fell from an elevated place on the site. Sometimes this is compounded by faulty scaffolding on the job site. There may be faulty machinery at the root cause of an injury. Chemical explosions and accidents involving other products that are in use have been known to cause serious injuries at a construction site.
Who is at fault when negligence occurs? Well, if it is a big job site, it gets complicated. It could be your employer, It could be another company that was contracted to work there (of which there could be many). It could a manufacturer. It could be the owner of the property or a developer. This is certainly a situation that requires the guidance of an experienced attorney, who can sift through all the possibilities and determine how much compensation you could be entitled to that might fall outside your workmen's compensation.
